Some aspects of qualifying acts under Article 105 of the Criminal Code of the Russian Federation

Human life as the highest value of society is often subject to various kinds of encroachments and needs high-quality criminal legal protection based on a combination of the punishment severity and the fairness of its appointment, which, first of all, is achieved through the competent offense qualification. The article is devoted to identifying the features and substantiating the difficulties arising from the law enforcement officer when classifying socially dangerous acts as crimes described in Art. 105 “Murder” of the Criminal Code of the Russian Federation. The objective and subjective signs of simple and qualified murder compounds are revealed, allowing them to be differentiated from each other, as well as to distinguish them from the privileged murder compounds and related articles of the criminal law, which provide for responsibility for the death of another person.
