The civil liability of an information intermediary for intellectual property rights infringement

The article deals with a relatively new concept in the Russian legislation — “information intermediary” and more specifically — the peculiarities of its civil liability. In the context of the existing in Russia mechanism of protection of intellectual rights the legal definition of the concept of “information intermediary” depending on the functions performed: transfer or placement of material in the information and telecommunications network, providing access to it, the specifics of its legal capacity is outlined. Cases of civil liability of information intermediaries and cases when this liability can be avoided are discussed in detail. The necessary actions of an information intermediary in case of detecting violations of intellectual rights are also indicated. A case in which the question of bringing an information intermediary to civil liability was considered.
